REGULATIONS FOR THE SALE AND RESERVATION OF ENTRANCE TICKETS TO THE MUSEUM OF PAPERMAKING IN DUSZNIKI-ZDRÓJ

 §1

Definitions

For the purposes of these Terms and Conditions, the following meanings of the following phrases are established:

  1. Museum - the Museum of Papermaking in Duszniki-Zdrój with its seat in Duszniki-Zdrój 57-340, at Kłodzka 42 Street, registered in the Register of Cultural Institutions under the number RIK: 3/1999, NIP: 8830005657, REGON Number: 890519046.
  2. System - the system for online reservation and purchase of Tickets available at the following address https://bilety.muzeumpapiernictwa.pl/index.html?lang=en
  3. Payment operator - electronic payment service provided by the operator designated by the Museum
  4. Website - the Museum's website available on the Internet at: https://bilety.muzeumpapiernictwa.pl/index.html?lang=en
  5. User - a person who makes a reservation or/and purchase of Tickets in the System.
  6. Ticket Office - a designated place in the Museum where Tickets can be purchased.
  7. Visitor - a person on the premises of the Museum who has purchased an Entrance Ticket entitling to use the Museum's offer.
  8. Registration - creation of an account in the System by the User.
  9. Ticket - a proof of purchase specifying the right of admission on a specific day at a specific time, to a selected service from the Museum's offer.
  10. Individual client - User entitled to purchase tickets for up to 9 persons.
  11. Group - User authorized to book and/or purchase tickets for 10 or more persons.
  12. Ticket Price List - determines the applicable prices of Tickets, rules for purchasing Tickets and rights to discounts; available at the Museum Box Office and on the Website.

§2

General regulations

  1. The following Regulations define the rules for the reservation and sale of tickets by the Museum of Papermaking in Duszniki-Zdrój with its seat in Duszniki-Zdrój 57-340, at Kłodzka 42 Street, registered in the Register of Cultural Institutions under the number RIK: 3/1999, NIP: 8830005657, REGON Number: 89051904
  2. The services offered by the Museum shall be charged for use, unless otherwise stated in the description of the service.
  3. Reservation and purchase of tickets is possible based on the availability of tickets.
  4. By proceeding to use the System, the User declares that he/she has familiarized himself/herself with the provisions of these Terms and Conditions and the Terms and Conditions of Visiting the Papermaking Museum available on the Website at the link: https://muzeumpapiernictwa.pl/regulamin-zwiedzania-muzeum-papiernictwa/ and accepts the terms and conditions thereof.
  5. the Price List of Tickets and the available offer of the Museum can be found at the Ticket Office and on the Website.
  6. Purchase of Tickets can be made at the Ticket Office or online through the System.
  7. The Museum reserves the right to amend and update the provisions of the Rules and Regulations at any time, whereby information on changes to the content of the Rules and Regulations, along with their updated version, will be posted each time on the Museum's Website.
  8. The Museum reserves the right to terminate the online sale at any time without giving any reason.
  9. The Museum stipulates that it is not liable for the inability to provide sold services as a result of external constraints that, despite the Museum's utmost diligence, make it impossible to carry out its statutory activities, including the provision of the cultural offer that is the subject of the sale.

§3

Ticket sales - general principles

  1. Tickets are sold:
  1. The purchased ticket must be presented to a museum staff member whenever he or she is called upon.
  2. Ticket sales at the Museum Box Office are handled through cash payments in PLN currency and non-cash payments: payment cards, contactless payment.
  3. A ticket purchased at the Box Office is issued in paper form.
  4. Online ticket sales are made by completing the form and following the steps indicated in the purchase instructions. The Museum draws attention to the User's obligation to complete the form accurately and completely. Failure to follow the instructions in the purchase process may prevent the successful purchase of a ticket. Providing incorrect data will make the purchase impossible.
  5. The user proceeding to purchase tickets online initiates the purchase procedure by placing the selected service in the System's shopping cart. Failure to pay within 30 minutes from the initiation of the purchase procedure results in automatic cancellation of services.
  6. The Museum is not responsible for the failure to deliver the ticket in case the User provides an incorrect e-mail address, as well as in case the message is stopped by the anti-spam system of the User's e-mail system.
  7. Online ticket sales are handled through cashless payments via payment operators designated by the Museum.
  8. The Museum issues invoices at the request of the Buyer, after making such a request during the ordering process and providing complete and correct data necessary for its issuance. Invoices are issued after payment has been made. In the case of online purchase, the Buyer agrees to send an invoice in electronic form to the indicated e-mail address.
  9. The Museum is not responsible for the consequences of the Buyer providing false or incorrect data necessary to complete the purchase, as well as for data transmission interference during the purchase.
  10. After paying for the online purchase, the ticket is sent to the e-mail address provided as a PDF attachment. Upon its receipt, the purchaser immediately verifies the correctness and compliance of the ticket with the order, in particular the amount, type of event, its date and time.
  11. The buyer is required to show the purchased ticket in electronic form (on the screen of an electronic device capable of reading the QR code/barcode) or printed in paper form. 

§4

User Registration

  1. Each User registering in the System will receive an e-mail message, at the address provided in the form, containing information about acceptance of the application and account registration in the System.
  2. The deletion of the individual account and personal data of the User from the System is done by sending an e-mail to: iod@muzpap.pl with the request for account deletion.
  3. The Museum reserves the right to automatically delete a User's account if the User does not use it for more than 1 year after its creation.
  4. The Museum shall not be liable for the consequences of making the data of an individual account of a User available to third parties and transactions carried out by unauthorized third parties who gained access to the User's account as a result of the failure to exercise caution when using the individual login and password to the account.

§5

Reservation and sale of tickets- detailed rules

  1. The Museum does not conduct ticket reservations for individual customers.
  2. An individual customer has the right to purchase tickets for up to 9 persons according to his/her generic rights, i.e. regular, discounted or family ticket.
  3. Use of the Museum's services as an organized group is possible after prior reservation and purchase through the System or at the Museum Ticket Office during operating hours.
  4. Groups have the right to purchase tickets for 10 and more people according to their generic entitlements, i.e. normal or discounted ticket.
  5. Buyers are required to respect the entry hour specified by the selected service indicated on the ticket. In case there are no entry hours specified on the ticket, the ticket is valid during the hours of availability of the facility or duration of the particular event/service with the last entry time before closing indicated by the Museum.
  6. Types of tickets:
  • Normal ticket - entitling to admission according to the basic prices specified in the Price List.
  • Reduced ticket - entitling to admission according to concessions granted to schoolchildren (with school/student ID) up to 26 years of age, pensioners (on the basis of an ID card), disabled persons (on the basis of an ID card/assignment).
  • A family ticket is a discount granted by the Museum of Papermaking to families with children, entitled to a maximum of two adults with children aged 7 to 18. It is granted to groups of 3 to 5 people.
  • Free ticket is available to: holders of the Card of Pole, children under 7 years of age, caregivers of disabled persons (disabled persons buy the entrance ticket according to the price list), museum workers (on the basis of an ID card), ICOM and ICOMOS card holders

§6

Refunds

  1. In case of inability to process tickets for reasons attributable to the Museum, the Buyer is entitled to return the purchased tickets with a request for refund of the amount paid.
  2. Refunds for tickets purchased online will be made using the same payment channels by which the payment was made or by transfer to the account indicated by the Buyer.
  3. Refunds for tickets purchased at the Museum Ticket Office shall be made only at the Museum Ticket Office.
  4. Purchased tickets shall not be refunded or exchanged for tickets at a different price or for a different event or a different event date, subject to the provisions of paragraphs 1 and 2 of this section. Damaged ticket (unreadable for scanning devices) is not refundable.
  5. In accordance with the provisions of Article 38 para. 12 of the Act of May 30, 2014 on consumer rights (Journal of Laws 2020.287 i.e. of 2020.02.21), the right of withdrawal from a contract concluded at a distance is not granted to the consumer with respect to services related to cultural events, if the contract specifies the day or period of service.

§7

Complaints

  1. The complaint may be submitted by e-mail to: rezerwacje@muzpap.pl In the complaint, the ordering party should indicate what the complaint is about, provide the reservation/order number and the reason for the complaint; however, the Museum is not responsible for incorrectly made complaints, in particular for the provision of incorrect or false data by the visitor.
  2. The buyer may file a complaint regarding the purchase of online tickets and the quality of services provided by the Museum within 14 calendar days from the date on which the event covered by the complaint occurred.
  3. The Museum is not responsible for non-delivery of the complaint message in case it is stopped by the anti-spam system of the Museum's email program.
  4. The complaint is processed by the Museum within 14 calendar days from the date of receipt of the complaint. Confirmation of the complaint is sent to the visitor by e-mail. The Museum shall inform the visitor of the result of the complaint consideration by e-mail to the address indicated in the complaint within a period not exceeding 14 calendar days from the date of its receipt.
  5. In order to consider the complaint, the Buyer, at the request of the Museum, is obliged to submit proof of the transaction.
  6. Consideration of the complaint by the Museum does not exclude the visitor's right to pursue claims under the general principles of the Civil Code and the provisions of the Consumer Rights Act of May 30, 2014. (Journal of Laws of 2014, item 827).

§8

Personal data protection

  1. The administrator of personal data is the Museum of Papermaking in Duszniki-Zdrój, 42 Klodzka Street, 57-340 Duszniki-Zdrój.
  2. In accordance with Article 13 (1) and (2) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016. (GDPR) you are informed that:
  • Personal data are processed on the basis of Article 6(1)(b) of the GDPR for the purpose of providing the online ticketing service.
  • Provision of personal data is necessary in order to perform the contract related to the purchase of a ticket.
  • Personal data are not transferred to a third country or other international organization.
  • Personal data is stored until the expiration of claims, as well as the fulfillment of obligations under the law, including tax and accounting in particular.
  • Personal data will not be processed by automated means, including profiling.
  • The person providing the data has the right to access the content of his data and the right to rectify, delete, limit processing, the right to data portability, the right to object. To this end, he shall notify the Administrator in writing.

  • In accordance with applicable law, the data obtained may be transferred to entities processing them on behalf of the Museum, e.g. subcontractors, and to entities operating IT systems related to sales, with such entities processing the data on the basis of a contract with the Museum exclusively and in accordance with its instructions, and to authorities authorized to receive such personal data by law.
  • The person providing the data has the right to lodge a complaint with the President of the Office for Personal Data Protection if he/she considers that the processing of his/her personal data violates the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. (GDPR).

§9

Final provisions

  1. Tickets purchased at the ticket office and online may not be copied and must be presented in a condition that allows their identification by the Museum's verification system.
  2. The Museum is not responsible for the functioning of the Internet network through which the reservation and/or purchase of tickets is made. The Museum is not responsible for messages or other data lost or misplaced on the Internet, individual computer settings and the way they are configured, or settings or service interruptions occurring at Internet access providers.
  3. (3) The Museum has the right to refuse to recognize the validity of tickets whose condition makes it impossible to identify the purchase transaction. This also applies to tickets lost by the Buyer.
  4. (4) The user, when booking tickets and/or purchasing tickets online, is obliged to read these regulations, provide truthful data, as well as not to send any content of a nature inconsistent with applicable regulations.
  5. (5) These regulations are available on the website and at the Museum ticket offices.
  6. (6) In accordance with the Regulation of the Minister of Finance of July 26, 2010 on exemptions from the obligation to keep records with the use of cash registers (Journal of Laws of 2010, No. 138, item 930), the sale of tickets in the scope of ordering and payment via the Internet is not subject to fiscalization, so the Buyer does not receive a fiscal receipt.
  7. Buyers who have purchased tickets entitling them to a discount at the Museum ticket offices or in the online sales system are required to show a document entitling them to a discount before entering the Museum. Tickets without a documented right to a discount do not entitle to use the service and are not refundable.
  8. Matters not covered by these Regulations shall be governed by the provisions of the Civil Code, the Consumer Rights Act and other relevant provisions of Polish law.
